1. The terms and conditions of the web-site (‘Site’) are binding on the User (‘you’, the person accessing the Site) and by accessing and continuing to use the web-site (‘Site’), the User is deemed to accept these terms and conditions.

2. We, Tout Ensemble, are a partnership. The address for all correspondence relating to this Site is as set out above.

3. We reserve the right to improve, amend or suspend the information/service provided on the Site without notice.

4. We reserve the right to alter these terms and conditions at any time with immediate effect by placing the amended terms and conditions on the Site.

5. Links to Site:

You may provide links to our homepage, http://www.toutensemble.co.uk/ but not directly to any other pages without our express prior written consent. We cannot guarantee any links to third party sites, nor can we provide any guarantees or accept any liability in respect of the content on such third party sites.

6. The Internet is not a secure medium and we provide no guarantees as to the reliability or security of the Site, or that it will be continuously available, error- or virus-free. 

Terms of Business

How to make a purchase

Please read the section How to Order. 

In brief, Tout Ensemble accept orders by post, by email, on-line via our website and by telephone. Any written orders must include the card holder's signature. 

Please note that having placed an order through the web-site, you will receive two e-mails automatically to confirm that i) we have received your order and ii) your payment has been taken by PayPal. However, these e-mails do not indicate that a contract exists between us. We will contact you further to indicate acceptance of your order, and hence a contract between us.  We have taken this step in case there has been a mistake in pricing on the Site, having inadvertently under- or over-priced items, an item is out of stock and we need to ask you if you want us to order it in, or we are no longer able to supply a particular product for some reason. If there is a price increase, we will contact you to ensure the price is acceptable or want to cancel the order. In addition, if items are out of stock or unavailable we will contact you to ascertain if you want to wait to order it in where possible, accept an alternative or cancel the order. Any refunds will be made promptly.

Prices and VAT Charges

Prices shown on our Site include 17.5% VAT.  (As stated above, if the price of a product you have chosen has been listed incorrectly, due to a typographical error or an increase in price that has not been updated on the Site, we will contact you to let you know so that you can then decide whether or not to proceed at this updated price.)

Please note also that, at your special request, we may able to order and bring in items of a size or specification which we do not normally stock. These, however, may incur a surcharge to offset any extra cost to us in obtaining them for you. If so, we will advise you of this to check whether or not you still want to proceed with the order.

Payment – Credit Card Security, etc. 

All payments are processed securely by PayPal, either by entering your credit or debit card details or through your own PayPal account if you have one. Credit cards accepted are Visa, Visa Delta, Mastercard,  Switch. At no point do Tout Ensemble see your credit card details. 

Alternatively, you can phone us with your credit/debit card details, or you can send us a cheque or credit/debit card details (with the cardholder's signature) in the post.

Postage and Packaging; Delivery

Most of our orders will be sent in gift boxes and all will be in robust packaging, with no indication of their content. Postage and packing is free for all orders despatched to the UK Mainland. For all other destinations outside of the UK mainland, postage and packing is added at checkout, having been calculated based on weight and size to the particular region. We will contact you to let you know when your goods have been despatched.

Goods will be sent by Special Delivery (UK) or International Signed For, with delivery timescales (after despatch) expected to be:

Special Delivery (UK) - within 3 working days

International Signed For - 7-10 working days

All delivery addresses will be copied as entered by the customer. If the carrier or post cannot deliver because addresses have been entered incorrectly by the customer, then we reserve the right to charge a supplement. Whilst we try to deliver all goods ordered in accordance with our pledge, we can accept no responsibility for any consequence of late delivery, however caused.

Despatch of Goods

We do hold a large amount of stock and aim to despatch those goods in stock within 48 hours. 

Please note that some items are not held in stock and are brought in by special order. These include (but are not limited to) standard corsets, all bespoke (made-to-measure) items corsets, leatherwear and other clothing. For non-stock items, we will contact you to let you know expected delivery times.

As a guide, standard (not bespoke) corsets and out-of-stock items are expected to be available for despatch within 5-14 days, but most much sooner. Bespoke items will take longer, up to 4-6 weeks and we will inform you of the expected time of delivery. 

Back Orders; Availability of Goods

If your item is not in stock, we will back order for you and aim to deliver within 28 days, depending on supplier availability. You will always be contacted with the option to cancel your order if you would rather not wait.

Damage in Transit; Shortage; Incorrect Goods; Non-Deliveries

Upon receipt , you should inspect the goods to determine whether or not:

i) they were damaged on arrival, ii) there are missing packages or items, iii) they were not what you ordered

Please note: All leather items are styled and created by cratsmen from the finest skins available. Leather is unique and individual. Apparent imperfections are not flaws but inherent natural markings which enhance the appearance of the garment.

You must inform us immediately if goods are delivered already damaged. Details must be recorded on the delivery documentation and we must be notified no later than 48 hours after delivery. (Keep all packaging as this will be required to effect the claim against the carrier.)

You also need to sign for the number of packages shown on the delivery or consignment note. If you suspect there are items missing from delivery, check first that the order has not been partly shipped. Any shortage must be noted on the delivery note and we must be informed within 24 hours.

If any goods delivered are not what you ordered, you must inform us within 24 hours. Do not open any manufacturers’ packaging and do not use the items, or we will not exchange any items suspected of having been used or if the packaging has been opened. 

We will not accept liability for any goods lost in transit unless are notified within 2 days of the expected delivery date. (We will have contacted you to inform you when goods are despatched and expected delivery timescale.)

We shall accept no liability for goods damaged on delivery, incorrect goods, shortages and non-deliveries outside of the stated timescales given above, except when there are extenuating circumstances preventing such notification with this timescale. 

We will not be under any liability to you for any delay or failure to deliver if the same is wholly or partly caused directly or indirectly by circumstances beyond reasonable control. 

In addition, we will not be liable under our agreement with you for any loss or damage caused by us where there is no breach of a legal duty or care owed to you by us, where any such loss or damage is not a reasonably foreseeable result of any breach of a legal duty or care, or any increase in loss or damage results from breach by you of any of these Terms. We are not responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and us.

As a consumer, you have certain rights by law regarding the return of defective goods and claims in respect of losses caused by any negligence on our part or our failure to carry out our obligations. These terms and conditions shall not affect your statutory rights.

Returns, Refunds and Exchanges

Tout Ensemble is committed to your complete satisfaction, so if you find the items you have ordered do not fit you or you are in any way dissatisfied with them, we will either give you a full refund or we will exchange them (for another size/colour or different item), with the exceptions expressly stated below, and  provided the following steps are taken:

1. When examining or trying on items, you have taken the utmost care to ensure that these items is not damaged or altered in shape or in any way that changes it from its original condition. For instance, footwear should be tried on wearing hosiery, not bare feet, standing on a carpeted surface, clothing must be tried while wearing suitable undergarments and without make-up or perfume. 

2.. You contact us, by e-mail or telephone, within 48 hours of received the goods, to obtain prior agreement with us for refund or exchange.

3. You return the goods to us in their original condition with all packaging and accessories, unworn and unwashed, with all labels intact (this includes not sticking sellotape to the product packaging or any other materials), within 14 days of despatch to you. If any item returned is marked or in any other condition which renders that item unfit for re-sale, it will not be accepted for refund or exchange and we will return it to you.  

4. You enclose your full contact details (name, address, e-mail, telephone number) and the original invoice enclosed with your delivery.

No refunds or exchanges will be given unless we receive the goods safely in their original condition and are fit for re-sale, as specified above, within our given deadline, under any circumstances.

Postage/Carriage and Costs

1. Ensure that you return items to us by Special Delivery or recorded delivery or any courier requiring a signature from us upon receipt, as we cannot accept responsibility for lost or damaged parcels. (The cost of returning items to us will be at your own expense.)

2. We will not charge postage or carriage on items sent in exchange for returned goods if sent to the UK Mainland (this applies to the first time of exchange only). A cost for postage/carriage and packaging will apply for other destinations.

3. If you wish to exchange any items again, we will change postage and packaging after the first exchange and this will be deducted via your original payment method.

Exceptions - Items Excluded from our policy for Refund and Exchange

Certain items are excluded from our returns policy, either for refund or exchange, unless faulty or in exceptional circumstances with our agreement.

Such items include:

1. All bespoke (made-to-measure) items, including corsets, leatherwear and other clothing. These have been made especially for you according to you measurements and specifications and cannot be re-sold.

2. All standard (non-bespoke) corsets. These have all been made to special order and, in addition, are of a personal nature, designed to be worn next to the skin.

3. All items of clothing and footwear in sizes and specifications which we do not normally stock and which have been bought in for you by special order at your request.
